This End User License Agreement ("EULA") is a legal agreement between you and The Brewz LLC, DBA F33LZ ("Licensor", "we", "us", or "our") governing your use of the F33LZ mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not download, install, or use the App.
1. Acknowledgment
You acknowledge that this EULA is concluded between you and F33LZ only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). F33LZ, not Apple or Google, is solely responsible for the App and its content.
2. Scope of License
F33LZ grants you a non-transferable, non-exclusive, revocable license to use the App on any Apple-branded or Android-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple App Store Terms of Service or Google Play Terms of Service.
3. Maintenance and Support
F33LZ is solely responsible for providing any maintenance and support services with respect to the App, as specified in this EULA or as required under applicable law. You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the App.
4. Warranty
The App is provided "as is" and "as available" without warranty of any kind. F33LZ disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, and they will refund the purchase price for the App to you (if applicable). To the maximum extent permitted by applicable law, Apple and Google will have no other warranty obligation whatsoever with respect to the App.
5. Product Claims
You acknowledge that F33LZ, not Apple or Google, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual Property Rights
You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, F33LZ, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
7. Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. User-Generated Content (UGC) and Objectionable Content
The App allows users to create, post, and share content ("UGC"). You agree not to use the App to create or share any content that is objectionable, offensive, unlawful, or violates the rights of others.
Zero Tolerance Policy: F33LZ has a zero-tolerance policy for objectionable content and abusive users. We employ moderation tools and human review to enforce this policy.
Reporting and Blocking: The App provides mechanisms for you to report objectionable content and block abusive users. We will act on reports within 24 hours by removing the offending content and ejecting the user who provided it.
9. Third-Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
10. Third-Party Beneficiary
You acknowledge and agree that Apple and Apple's subsidiaries, and Google and Google's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
